Heart & Stroke Lottery Rules & Regulations
By purchasing a ticket from Heart and Stroke Foundation of Canada (the “Foundation” or “Heart & Stroke”) for the Winter 2027 Heart & Stroke Lottery, the Purchaser acknowledges they have read, understood, and agreed to these rules and regulations (“Rules”). “Purchaser” means a person: (i) purchasing a ticket(s) for his/her personal use; (ii) purchasing a ticket(s) on behalf of a group where the purchaser’s name and up to two additional names and/or a group name appear on all ticket(s), or (iii) purchasing a ticket(s) that is allocated to another individual or group of which the Purchaser is not a member. The Purchaser’s name shall always appear as the first name on any ticket purchased. All Purchasers are subject to these Rules. The Foundation has no obligation or liability to any person named on a ticket other than the Purchaser. The liability of the Foundation shall be limited to the purchase price of the ticket. It is the responsibility of the Purchaser to allocate the prize if necessary.
Eligibility: Ticket Purchasers and any other persons named on a ticket must be at least 18 years of age. Tickets must be purchased within the province of Ontario and cannot be mailed outside of Ontario. Only tickets that have been paid and verified as paid by the respective sales deadline are eligible. The Rules prohibit the following individuals and all persons residing in the same household as these individuals from purchasing a ticket: Employees and Board Directors of the Foundation; partners and employees of the ticket fulfillment service provider and its affiliates; and employees of licensed gaming suppliers for the Lottery.
Tickets: The official ticket is a receipt of purchase. Ticket purchases are not tax deductible. Only one method of payment may be used per order. Tickets are only refundable prior to the draw date for which they are eligible. Official tickets will be delivered to the customer via email and/or letter mail. Where an email address is not provided, physical tickets will be mailed to the mailing address provided at the time of the order. It is the Purchaser’s responsibility to ensure that ticket(s) are received before the applicable draws commence, however, purchasers do not need physical tickets to be included in the draws. The Foundation is not responsible for orders that are not received on time or at all. Notwithstanding anything contained herein to the contrary, the total liability of the Foundation to any Purchaser shall be limited to the purchase price of the ticket.
Up to three names may be recorded on a Lottery ticket. The Purchaser must be named on the ticket. Any requests to change the name(s) on an official ticket must be received prior to the draw date for which the ticket is eligible. For mail orders only, the change of name must be accompanied with a copy of the Purchaser’s government issued photo ID.
Prize Claim: Prizes will be awarded to the Purchaser named on the official ticket. A copy of a valid government issued photo ID, which includes address information, may be required to claim the prize. Prize(s) must be claimed no later than six months after the final draw date. Unclaimed prizes will be reported and a charitable allocation to the Foundation will be approved by the Alcohol and Gaming Commission of Ontario (“AGCO”). In the event of a discrepancy, the official records of the Foundation will be deemed correct and final. By claiming a prize, the winner (i.e., successful purchaser) consents to the use of their likeness (photograph, if available), first and last name, ticket number, city or town of residence, video recording (when available only) and transcription/recording of the winner notification phone call to be used for any publicity purposes by the Foundation. Vehicle winners are responsible to licence and insure the vehicle from the time of ownership. Winners may be required, at Heart & Stroke’s discretion, to sign a full & final waiver and release prior to transfer of the prize and may be required to sign a full & final waiver and release of the prize supplier.
The Foundation is only responsible for communicating with the Purchasers and is not responsible for any prize entitlement of any other individual(s). Prizes stated are retail value with taxes, freight and applicable fees included as of the date contracts were agreed upon with suppliers and are independently verified by prize supplier, as per AGCO rules.
Release: The Purchaser agrees to release and hold harmless the Foundation, its affiliates and its directors, members, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Lottery (collectively, the “Releasees”) from and against any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and damage to property, arising in whole or in part, directly or indirectly, from their participation in the Lottery or their acceptance, possession, use or misuse of the Prizes. Each Purchaser acknowledges that the Releasees have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes or the Lottery. Apart from manufacturer warranties (which may not be available in all geographies), all warranties are hereby disclaimed.
